Socialist deputies will register on Thursday, October 26, a bill on the Constitutional Court, according to which the judges of the Constitutional Court will be prohibited from possessing dual citizenship. In addition, the procedure for prosecuting judges of the Constitutional Court for committed violations or crimes will be simplified.
“Changes will be initiated in the Criminal Code, the Code of Constitutional Jurisdiction and the Constitutional Court Law in such a way to facilitate the procedure for prosecuting judges of the Constitutional Court who violate the law, changing the Constitution for themselves, exceeding their official powers and contributing to usurpation the state power. We believe that today the Constitutional Court does not meet the interests of the Constitution, the state, and exists only for one party – the Democratic Party of Vladimir Plahotniuc. Today, the CC, unlike more civilized states, does not work with people. Our citizens do not have the right to apply to the Constitutional Court, this court serves exclusively the authorities,” said the deputy from PSRM Vlad Batryncha.
The people’s deputy noted that this is not about the reform that will follow necessarily, but after the parliamentary elections, but that if the judges of the constitutional court, like any high-ranking government officials, violate the law, there must be a clearly stipulated procedure for bringing them to criminal responsibility.
According to the deputy from the PSRM Vasily Bolea, to date, if the Constitutional Court judge has violated the law, the decision to bring him to justice is taken not by law enforcement bodies, but by the other judges of the Constitutional Court. He also noted that the judges of the Constitutional Court additionally have absolute immunity, which neither the President of the country, nor the chairman of parliament has. Precisely because of the impunity within the walls of the Constitutional Court, such decisions are born as on 17 and 19 October this year.
“The Constitution in the Republic of Moldova will be defended by judges who possess Moldovan citizenship, and not judges who were previously deputies of the parliament of another country and gave the oath of allegiance to another country and other people,” concluded Vlad Batryncha.
