Irina Vlah: The final ENEMO report confirms that the Republican Party “Inima Moldovei” and its candidates were abusively excluded from the electoral race

The Republican Party “Inima Moldovei” welcomes the final report of the ENEMO Election Observation Mission, “which confirms what our party has long denounced: the 28 September 2025 elections were held within a legal framework marked by major deficiencies that allowed the abusive exclusion of certain electoral competitors from the race.”

According to the political party, “the ENEMO report clearly states:

  • Recent amendments to the Law on Political Parties allow the authorities to request the court to limit or suspend the activity of a party during the election campaign. The broad wording of the provision and its application shortly before election day give the authorities excessive room for intervention, while appeal procedures often coincide with election day. This endangers the right to stand for election, undermines legal certainty, and restricts access to effective remedies.
  • The practice observed during these elections revealed shortcomings in the application of admissibility rules, insufficient transparency, and the absence of a clear mechanism for monitoring complaints, as well as the late use of financial sanctions that led to the cancellation of candidates’ registration right before election day, without a real possibility of appeal.
  • Legislation on extremism, party regulation, and security requires urgent revision to clearly define grounds for intervention, ensure proportionality of restrictions, and guarantee the protection of fundamental rights of competitors.
  • The possibility of limiting the activity of political parties must be treated as an exceptional, last‑resort measure, with prior notification and effective judicial oversight, to ensure a real opportunity for legal remedy before elections.
  • Clear procedures must be established for the use of classified information in electoral matters, so that courts can examine evidence and competitors can defend their rights within a reasonable timeframe.”

In a video address, party leader Irina Vlah stressed that the ENEMO report confirms that the Republican Party “Inima Moldovei” and its candidates were abusively excluded from the electoral race, based on alleged and unproven suspicions, without an assessment of proportionality and without access to an effective appeal, under a law adopted contrary to Council of Europe standards and in violation of legal certainty.

“In these circumstances, the Republican Party ‘Inima Moldovei’ reiterates its demands to the responsible state authorities:

  • To Parliament — urgently revise the legislation adopted through abuse of law;
  • To the Ministry of Justice — exercise its discretionary powers in the spirit of the rule of law and revoke the abusive limitation of the activity of the Republican Party ‘Inima Moldovei’, applied by the court as a provisional measure;
  • To the Constitutional Court — declare unconstitutional the abusive provisions of the Law on Political Parties.

The Republican Party ‘Inima Moldovei’ reaffirms its principled position and its commitment to continue the fight for restoring the fundamental rights violated through abuse of law by the responsible state institutions,” the politician added.
