Today, the Vetting Commission transmitted its decisions to Parliament and the Ministry of Justice regarding the evaluation of candidates for membership in the Superior Council of Magistracy (SCM) and the Disciplinary Board of Judges from civil society. Following the evaluation process, the Commission found that Anatolie Minciuna, a former judge, and Vitalie Ciuchitu, an attorney-at-law, who are both candidates for SCM, along with Ion Rusu, also an attorney-at-law and candidate for both SCM and the Disciplinary Board, failed the evaluation. According to the Commission’s decisions, the candidates do not meet the integrity criteria set out in Law 26/2022, based on which they were evaluated.

The Vetting Commission has published the evaluation results on its official website, as per the established procedures. Candidates have 48 hours to notify the Commission if they oppose or not the publication of the decisions. In the absence of such notification, the decisions will be published on the Commission’s website, available at www.vettingmd.eu. The Commission’s evaluation decisions can be challenged at the Supreme Court of Justice within 5 days.

Status update on the evaluation of candidates for SCM and the Disciplinary Board of SCM: Out of the five candidates for the Superior Council of Magistracy (SCM) from civil society, sent by Parliament to the Vetting Commission for evaluation, two candidates passed the evaluation, while three failed. Additionally, the evaluation of a candidate for SCM from the courts of appeal is ongoing. Regarding candidates for the Disciplinary Board of Judges, the Commission issued a fail decision, five decisions are pending, and the evaluation of six candidates is in progress.
