The decisions of the Evaluation Commission: Four non-judge candidates to the CSM passed 

The Pre-Vetting Commission announces the outcome of the evaluation of five non-judges from the second group of non-judicial candidates, nominated by the Parliament for the position of member in the Superior Council of Magistracy (SCM). According to the Commission, Aliona Corcenco, Veaceslav Guțan, Vitalie Sîli and Iulian Muntean meet the criteria of financial and ethical integrity and pass the evaluation, while candidate Ana Tipa fails the evaluation. Detailed information about the evaluation is contained in the decisions sent today to the candidates and the institution responsible for organizing the elections or contest, in this case the Parliament.

At this stage, the Commission is only entitled to communicate information on the outcome of the evaluation, as decisions can only be published with the consent of the candidates concerned. They shall notify the Commission whether or not they oppose the publication within 48 hours after the receipt of ng the decision, in accordance g to the Law No. 26/2022. Under the Evaluation Rules, the decisions in depersonalized form will be posted on the Commission’s website in English and Romanian. Decisions may be appealed to the Supreme Court of Justice within 5 days from the receipt, under the provisions of the same law.

At the end of July, the Pre-Vetting Commission concluded the hearing of candidates from group II of non-judges proposed by the Parliament for positions in the SCM. Out of 9 candidates with professional experience in the field of law or in another relevant field, included in the list sent to the Commission by the Parliamentary Legal, Appointments and Immunities Committee on 5 May 2023, eight candidates participated in the hearings of the Pre-Vetting Commission, as one withdrew from the competition. Therefore, so far, four candidates passed the evaluation, two candidates failed the evaluation, and three other candidates are awaiting the decisions of the Commission in order to become eligible for membership in the SCM.
