Law on amending, supplementing Audiovisual Code promulgated today

The decree promulgating the law on amending and supplementing the Audiovisual Code was signed today by Parliament Speaker Andrian Candu, after the Constitutional Court has found the circumstances justifying the interim office of president for its promulgation, the parliament’s communication and public relations department has reported.

On 22 December 2017, the parliament maintained the vote for the law No257, known as anti-propaganda law, submitted for review by the president.

Thus, the new rules are included in the Audiovisual Code to ensure the protection of people, society and state from possible attempts of misinformation or manipulative information from outside and to prevent mediation challenges against Moldova.

Also, it is provided for broadcasting informational, analytical, military and political television and radio programs produced in the member states of the EU, USA, Canada, as well as in the states which have ratified the European Convention on Transfrontier Television.

Under the Article 93(2) of the Constitution, the Moldovan president is entitled, if he objects against a given law, to submit it within at most two weeks to parliament for reconsideration. If the parliament maintains its previously adopted decision, the president promulgates the law. At the same time, after the deliberate refusal of the head of state to fulfill the constitutional obligations to promulgate the law on 5 January 2018, the Constitutional Court found the circumstance justifying the interim office of president.

According to the notification by the court, under the Article 91 of the Constitution, the Parliament Speaker holding the interim office issued the decree promulgating the Law No257 of 22 December 2017 on amending and supplementing the Audiovisual Code of Moldova.
